Jakarta (ANTARA News) - The Attorney General`s Office (AGO) considers the cases of antigraft (KPK) officials Bibit Samat Rianto and Chandra M Hamzah not fit for presentation to a court of law, a spokesman said.

Therefore, the South Jakarta public prosecutor`s office would issue a decision to stop the prosecution process against the two KPK officials, Junior Attorney General for Special Crimes Marwan Effendi said here Monday.

"Their cases are not fit for prosecution in the South Jakarta Distirct Court," Marwan said at a press conference.

He said juridically their action had actually met the definition of an offense contained in Article 12e and Article 23 of the Corruption Law.

But the AGO had decided to stop prosecuting them because it realized the two had been unaware of the possible impact of their actions as they thought it was a normal thing to do as their predecessors had also acted likewise.

Bibit Samat Rianto and Chandra M Hamzah had been named suspects by the police on charges of abusing their power by issuing a travel ban on corruption suspect Anggoro Widjojo. The police argued that under the KPK law they should have done it with the approval of other KPK leaders which they did not. Anggoro Widjojo is now still at large.

Marwan Effendy said the AGO had also decided to drop the cases because the situation was not conducive for continuing the prosecution of the duo. "The disadvantage (of continuing it) outweighs its advantage," he added.

The decision was also taken to maintain harmony in the relationship between the AGO. the National Police and KPK.

Marwan said "the people also consider the duo not deserving to be blamed for their actions because they needed a breakthrough to carry out their tasks."

He also said the AGO`s decision was made not because of any pressure from any party.(*)
