Jakarta (ANTARA News) - State power firm PT PLN said that only 9,711 or 25 percent of the 38,449 industrial subscribers enjoyed the capping of not more than 18 pct of the power price hike.

"Only 25 percent of the industrial subscribers enjoyed the capping," PLN`s business and risk management director Murtaqi Syamsuddin said here Sunday.

He said PLN was facing a dilemma in the capping issue of the industries.

He said the energy and mineral resources minister has warned PLN to respect the agreement reached between the government and House VII of the House of Representatives in their meeting on July 19, 2010, on the capping of capping 18 percent for industrial subscribers.

"The capping decision had caused a disparity between industrial subscribers when it comes to the price of power which must be paid," he said.

Murtaqi said in facing the dilemma PLN is referring back the the positive law in the country.

"PLN needs security and certainty in policy which if carried out would not affect the law.
PLN also hoped the policy in place will maintain the favorable investment climate and sound business competition," he said.

Murtaqi said PLN had already consulted with the Business Competition Supervisory Commission (KPPU) and sent a letter on January 11, 2011.

He said PLN wished to be sure with regard to KPPU, whether to eliminate the price disparity by with full enforcement of the power price according to the regulation of the energy minister No 7 of 2010 and Law 5 of 1999.

Murtaqi hoped for an earliest KPPU decision so that PLN would have a certain legal basis, and to end the issues and problems on the elimination of capping. (*)
